Terms and Conditions of Use

Playmates Australia provides an online advertising and directory platform for adults. The platform allows eligible advertisers to publish listings for lawful adult-oriented companionship, escort, social introduction, entertainment, or related services in Australia.

Playmates Australia is an advertising platform only. We do not provide escort services, adult services, companionship services, sexual services, booking services, agency services, employment services, management services, or personal services. We do not act as an agent, representative, employer, contractor, broker, or partner of any advertiser or user.

Any contact, communication, meeting, booking, arrangement, payment, or dispute between a user and an advertiser is strictly between those parties. Playmates Australia is not a party to those arrangements.

In these Terms:

• "Advertiser" means a person or business that creates, submits, pays for, manages, or appears in an advertisement on Playmates Australia.
• "Advertisement" means any profile, listing, image, text, contact detail, rate, description, location, schedule, promotion, or other material submitted for publication on the Site.
• "Content" means any text, image, photograph, video, profile information, link, message, review, or other material uploaded, submitted, displayed, or transmitted through the Site.
• "Services" means the advertising, listing, publication, account, moderation, payment, communication, and platform services provided by Playmates Australia.
• "Site" means the Playmates Australia website, platform, mobile pages, account areas, payment areas, and any related digital services.
• "User" means any person who visits, browses, searches, contacts an advertiser, creates an account, or otherwise uses the Site.
• "We", "us", and "our" mean Playmates Australia.
• "You" and "your" mean any User, Advertiser, account holder, or person using the Site.

The Site and Services are strictly for persons aged 18 years or older.

You must not access, browse, register for, advertise on, contact advertisers through, or use Playmates Australia unless you are at least 18 years old and legally capable of entering into binding agreements.

You must not use the Site on behalf of a person under 18. You must not upload, publish, request, distribute, promote, or engage with any content involving a person under 18.

We may request age, identity, consent, or ownership verification at any time. If verification is refused, incomplete, inaccurate, or unsatisfactory, we may refuse, suspend, or terminate access to the Site.

Playmates Australia allows advertisers to submit advertisements for possible publication on the Site.

We may publish, reject, moderate, suspend, remove, edit, format, classify, restrict, or refuse any advertisement at our discretion. Acceptance of payment does not guarantee that an advertisement will be published or remain published.

We do not guarantee enquiries, bookings, profile views, ranking, search placement, income, responses, or any particular commercial outcome from an advertisement.

We do not verify every statement made by advertisers. Users must make their own enquiries and exercise their own judgment before contacting or dealing with any advertiser.

To use certain Services, you may need to create an account.

You agree that all information you provide to Playmates Australia will be accurate, current, complete, and not misleading. You must keep your account information updated.

You are responsible for keeping your login details secure. You must not share, sell, transfer, lease, or allow another person to use your account without our written consent.

You must notify us promptly if you believe your account has been accessed without authority or if your login details have been compromised.

We are not responsible for loss caused by your failure to protect your account, except to the extent that liability cannot be excluded by law.

Advertisers are solely responsible for their advertisements, services, representations, pricing, availability, conduct, communications, and compliance with all applicable laws.

By submitting an advertisement, you warrant that:

• you are at least 18 years old;
• each person shown, described, or referred to in the advertisement is at least 18 years old;
• all people appearing in images or content have given valid consent for that content to be used on Playmates Australia;
• you own the content or have the legal right to use and publish it;
• the advertisement is accurate, current, lawful, and not misleading;
• the advertisement does not impersonate another person;
• the advertisement does not promote unlawful services or unlawful conduct;
• you will comply with all applicable Commonwealth, State, Territory, local government, planning, workplace health and safety, tax, privacy, consumer, anti-discrimination, advertising, and criminal laws;
• you will maintain any records, licences, permissions, releases, consents, or evidence reasonably needed to prove compliance with these Terms.

You must immediately update or remove any advertisement that becomes inaccurate, unlawful, expired, misleading, or no longer authorised.

Users must deal with advertisers respectfully, lawfully, and at their own risk.

You must not use Playmates Australia to harass, threaten, stalk, coerce, exploit, blackmail, intimidate, abuse, record without consent, impersonate, deceive, or unlawfully pressure any person.

You must not request, encourage, negotiate, arrange, or participate in unlawful activity.

You acknowledge that Playmates Australia does not control private communications, private meetings, personal arrangements, or transactions between users and advertisers.

You must not upload, submit, publish, transmit, or link to content that:

• involves or appears to involve a person under 18;
• promotes child exploitation, child sexual abuse, grooming, trafficking, servitude, coercion, or non-consensual conduct;
• is false, deceptive, misleading, or likely to mislead;
• uses another person's name, image, likeness, trade mark, copyright material, private information, or identity without permission;
• contains threats, harassment, abuse, hate speech, discrimination, humiliation, or unlawful vilification;
• promotes violence, criminal conduct, unsafe conduct, or illegal drugs;
• contains malware, spyware, tracking code, phishing material, or harmful code;
• breaches another person's privacy, confidentiality, intellectual property, or legal rights;
• contains unsolicited commercial material, spam, or misleading promotions;
• is unlawful, restricted, refused classification, or required by law to be removed or access-restricted.

We may remove or restrict content that we consider unacceptable, unlawful, unsafe, high risk, or inconsistent with these Terms.

Advertisers must only upload images that they own or are authorised to use.

You must not upload images of another person unless that person has given express permission for the image to be used on Playmates Australia.

You must not upload stolen images, fake images, AI-generated images presented as real people, screenshots from social media without permission, watermarked content belonging to another platform, or content that infringes another person's rights.

We may request proof of identity, age, copyright ownership, model consent, or image authorisation. We may remove images at any time if we are not satisfied that they are lawful and authorised.

All advertisements may be subject to review before or after publication.

Moderation is undertaken to reduce legal, safety, platform, and user risk. It does not mean we endorse, verify, approve, certify, or guarantee any advertiser or advertisement.

We may delay, reject, edit, reclassify, restrict, suspend, or remove content for any reason, including suspected breach of these Terms, legal risk, payment issues, complaints, safety concerns, or operational requirements.

We are not liable for loss arising from moderation delays, rejected advertisements, removed content, account suspension, or refusal to publish, except to the extent liability cannot be excluded by law.

Advertising options, prices, durations, inclusions, promotional placements, and renewal options are displayed on the Site or otherwise communicated by Playmates Australia.

All fees are payable in Australian dollars unless stated otherwise.

Payment must be received and cleared before an advertisement is published, renewed, upgraded, boosted, or extended.

An advertising period starts when the advertisement is activated, published, or otherwise made available through the Site, unless the Site states a different start time.

Advertising fees do not guarantee enquiries, bookings, ranking, placement, profile views, or revenue.

We may change advertising packages, prices, features, categories, display rules, ranking logic, or promotional options from time to time. Changes will not affect a paid advertising period already purchased unless required by law or these Terms.

Advertisements may expire at the end of the paid advertising period.

You are responsible for renewing an advertisement before expiry if you want it to remain active.

If an advertisement expires, we may remove, hide, archive, or deactivate it.

We are not required to preserve expired advertisements indefinitely.

Refunds are handled in accordance with these Terms and any refund policy published by Playmates Australia.

Unless required by law, advertising fees are not refundable once an advertisement has been submitted for moderation, approved, published, activated, upgraded, boosted, or otherwise used.

We may refuse a refund where an advertisement or account is suspended, rejected, or removed because of a breach of these Terms, unlawful conduct, misleading information, unauthorised content, failed verification, payment dispute, or safety concern.

Nothing in these Terms excludes, restricts, or modifies any right you have under the Australian Consumer Law or any other law that cannot be excluded. Where we are permitted to limit our liability, our liability is limited to resupplying the relevant Services or refunding the amount paid for the affected Services.

Payments may be processed by third-party payment providers.

You agree to comply with the terms, conditions, and policies of any payment provider used to process your payment.

We are not responsible for delays, refusals, chargebacks, processing errors, card issues, bank fees, account restrictions, or other acts or omissions of third-party payment providers, except to the extent caused by us or required by law.

If you initiate a chargeback, reversal, payment dispute, or payment cancellation without first attempting to resolve the issue with us, we may suspend or terminate your account and remove your advertisements while the matter is investigated.

You must not use chargebacks to avoid legitimate advertising fees.

We may recover from you any unpaid fees, chargeback costs, administrative costs, debt recovery costs, or legal costs reasonably incurred because of an improper payment reversal or unpaid account.

You retain ownership of content you submit to Playmates Australia.

By submitting content, you grant Playmates Australia a non-exclusive, royalty-free, worldwide licence to host, store, copy, publish, display, format, crop, resize, moderate, adapt for technical purposes, promote, and distribute that content for the purpose of operating, displaying, marketing, moderating, and improving the Site and Services.

This licence continues while the content is published, stored, cached, archived, or reasonably required for legal, compliance, record-keeping, dispute, backup, enforcement, or operational purposes.

You warrant that our use of your content in accordance with these Terms will not infringe any person's rights.

All intellectual property in the Site and Services, including software, design, branding, logos, layout, text, databases, systems, processes, graphics, trade marks, and platform functionality, belongs to Playmates Australia or its licensors.

You must not copy, scrape, reproduce, modify, reverse engineer, frame, mirror, sell, licence, exploit, or create derivative works from the Site or Services without our written permission.

You are granted a limited, revocable, non-exclusive, non-transferable right to use the Site for its intended purpose and in accordance with these Terms.

You must not:

• use the Site for unlawful purposes;
• use the Site if you are under 18;
• submit false, misleading, stolen, or unauthorised information;
• scrape, harvest, copy, index, or extract data from the Site;
• use bots, crawlers, automation, scripts, or data-mining tools without permission;
• interfere with the Site's security, availability, ranking, payment systems, or moderation systems;
• attempt to bypass age checks, verification, moderation, suspension, or access restrictions;
• send spam or unsolicited messages;
• collect advertiser or user information for off-platform marketing;
• upload malware or harmful code;
• damage the reputation, security, operation, or integrity of Playmates Australia;
• assist another person to breach these Terms.

You may report content, conduct, intellectual property concerns, impersonation, privacy concerns, safety concerns, or suspected unlawful activity through the contact options displayed on the Site.

We may investigate reports at our discretion.

We may remove content, request evidence, suspend accounts, preserve records, provide warnings, restrict access, or refer matters to law enforcement, regulators, payment providers, or other relevant parties where appropriate.

Submitting a report does not guarantee removal, reinstatement, refund, or a particular outcome.

Playmates Australia may take steps designed to improve user safety, advertiser safety, legal compliance, moderation quality, and platform integrity.

Those steps may include account verification, age checks, identity checks, content moderation, user reporting tools, payment review, audit trails, account restrictions, keyword controls, image review, and cooperation with lawful requests.

Advertisers and users remain responsible for their own safety, decisions, conduct, communications, and legal obligations.

Our handling of personal information is governed by our Privacy Policy and applicable privacy laws.

By using the Site, you consent to the collection, use, storage, disclosure, and handling of your personal information as described in our Privacy Policy.

You must not upload another person's personal information without lawful authority and consent.

You must not use personal information obtained through Playmates Australia for harassment, stalking, blackmail, doxxing, unsolicited marketing, impersonation, or any unlawful purpose.

If you subscribe, register, advertise, or otherwise consent to receive communications from us, we may send you service-related messages and, where permitted, marketing communications.

Commercial electronic messages must comply with applicable spam and marketing laws.

You may unsubscribe from marketing communications using the unsubscribe method provided or by contacting us through the Site. Service, billing, safety, legal, and account-related communications may still be sent where necessary.

We may update, suspend, withdraw, modify, replace, restrict, or discontinue all or part of the Site or Services at any time.

We do not guarantee that the Site will be uninterrupted, error-free, secure, compatible with every device, or available at all times.

We may perform maintenance, upgrades, security changes, or operational changes without notice.

Publication of an advertisement does not mean Playmates Australia endorses, recommends, verifies, guarantees, employs, manages, represents, or approves the advertiser.

Any opinions, statements, images, claims, rates, descriptions, availability, or services in an advertisement are the responsibility of the advertiser.

Users must make their own enquiries before contacting, meeting, booking, paying, or dealing with any advertiser.

To the maximum extent permitted by law, the Site and Services are provided on an "as is" and "as available" basis.

We do not warrant that:

• advertisements are accurate, complete, lawful, current, or genuine;
• advertisers or users will act honestly, safely, or lawfully;
• the Site will generate enquiries, bookings, views, rankings, or income;
• content will not be copied, misused, downloaded, indexed, screenshotted, or redistributed by third parties;
• the Site will be free from errors, interruptions, security incidents, or technical issues.

Nothing in these Terms excludes any warranty, guarantee, right, or remedy that cannot lawfully be excluded.

To the maximum extent permitted by law, Playmates Australia is not liable for indirect, consequential, special, exemplary, punitive, or economic loss, including loss of profit, revenue, opportunity, goodwill, data, reputation, privacy, business, or anticipated savings.

We are not liable for loss arising from:

• private dealings between users and advertisers;
• advertiser content;
• user conduct;
• unlawful or unsafe conduct by third parties;
• payment provider issues;
• moderation decisions;
• account suspension or termination;
• expired, rejected, or removed advertisements;
• unauthorised copying or misuse of public content by third parties;
• technical interruptions or platform changes.

Where liability cannot be excluded but can be limited, our liability is limited to the resupply of the relevant Services or the amount paid by you for the affected Services.

You agree to indemnify Playmates Australia against claims, losses, liabilities, damages, costs, and expenses arising from or connected with:

• your use of the Site or Services;
• your advertisement or content;
• your breach of these Terms;
• your breach of any law;
• your infringement of another person's rights;
• your dealings with another user or advertiser;
• your payment obligations;
• any false, misleading, unlawful, unauthorised, or infringing content you submit;
• any tax, licensing, employment, agency, safety, or regulatory issue connected with your own services or business.

This indemnity continues after your account ends or your advertisement is removed.

We may suspend, restrict, or terminate your account or access to the Site at any time if we reasonably believe that:

• you have breached these Terms;
• your content is unlawful, unsafe, misleading, or unauthorised;
• you have failed verification;
• your payment is disputed, reversed, unpaid, or suspicious;
• your conduct creates legal, safety, reputational, operational, or commercial risk;
• we are required or encouraged to do so by law, a regulator, payment provider, or law enforcement authority;
• continued access would be inappropriate.

We may remove advertisements immediately on suspension or termination.

Termination does not affect rights or obligations that arose before termination.

Advertisers are responsible for their own tax, GST, business registration, record-keeping, employment, contractor, insurance, licensing, reporting, workplace, planning, health, safety, and regulatory obligations.

Playmates Australia does not provide tax, legal, accounting, employment, or business advice.

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including outages, cyber incidents, payment provider failure, hosting failure, legal change, regulator action, natural disaster, industrial action, pandemic, war, civil unrest, or telecommunications failure.

We may update these Terms from time to time.

Updated Terms will apply from the date they are published on the Site or otherwise notified, unless a later effective date is stated.

Your continued use of the Site after the Terms are updated means you accept the updated Terms.

If you do not agree to updated Terms, you must stop using the Site and Services.

If any part of these Terms is invalid, unlawful, or unenforceable, that part will be read down or removed to the extent necessary, and the remaining parts will continue to apply.

If we do not enforce a right under these Terms, that does not mean we waive that right.

A waiver is only effective if made in writing.

You must not assign, transfer, or novate your rights or obligations under these Terms without our written consent.

We may assign, transfer, subcontract, or novate our rights or obligations where reasonably necessary for business, legal, operational, restructuring, sale, or compliance purposes.

These Terms are governed by the laws applicable in Australia, including applicable Commonwealth, State, and Territory laws.
